How fees are split
Victorian owners corporations must set annual fees based on lot liability. There is a limited exception: an extra annual fee can be charged to a lot whose particular use creates extra costs. See the Owners Corporations Act 2006 (s 23) and Consumer Affairs Victoria — fees.
What lot liability is
Lot liability sets each lot's share of costs. On new plans it is allocated equally unless there are substantial differences in lot size or use of common property. CAV — developers' obligations.
Maintenance plans
Tier 1 (more than 100 occupiable lots) and tier 2 (51–100) must have a maintenance plan and fund. Tiers 3–5 — most small OCs — may choose to. See CAV tiers and maintenance plans. A plan covers major capital items over the next 10 years.
Fee notices and late payment
Fees are invoiced on an approved fee notice and are due within 28 days. If the OC has voted to charge interest, the notice must state the rate. See s 31 and CAV fees. Owners in arrears cannot vote on ordinary resolutions.
Disputes
Fee disputes go through your OC's dispute process first; VCAT can hear owners corporation disputes.
